Legal Agreement

Welcome, and thank you for your interest in GradeAssist Education Inc., a Canadian corporation in the jurisdiction of Ontario, and GradeAssist Inc., a Delaware corporation (collectively "GradeAssist," "we," "us," or "our") and our website at www.vibegrade.com, our Chrome extension, related websites, hosted applications, and other services (collectively, the "Service"). These Terms and Conditions, including GradeAssist's Privacy Policy (available at: https://vibegrade.com/privacy), (together, these "Terms") are a legally binding contract between you and GradeAssist regarding your use of the Service.

By accessing or using the Service, you agree that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

Introduction

VibeGrade is the product name of GradeAssist's AI-powered grading assistant platform. By accessing or using our services, you agree to comply with and be bound by the following Terms of Service. Please read these terms carefully before using VibeGrade.

Acceptance of Terms

By using VibeGrade, including our free trial (25 essays per month) or subscribing to our paid service, you agree to the Terms of Service outlined here. If you do not agree with any part of these terms, you must refrain from using our services.

Services Offered

VibeGrade is an AI-powered tool designed to help teachers streamline grading by providing the following services:

  1. Plagiarism Detection: We check essays for instances of plagiarism.
  2. AI Writing Detection: We analyze whether the essay contains content generated by AI.
  3. Smart Annotations: Our system generates insightful comments and annotations on essays based on your specified criteria.
  4. Essay Breakdown: We provide a comprehensive breakdown of the essay based on your provided grading rubric or other key metrics.
  5. Grade Estimates: VibeGrade offers grade estimates based on the essay analysis; however, the final grade is at the sole discretion of the teacher.

User Responsibilities

  1. Final Grading: While VibeGrade provides suggestions and predictions, the final decision and responsibility for assigning grades rests with the teacher. VibeGrade is a supplementary tool and not a replacement for professional judgment.

  2. Data Accuracy: The data provided by VibeGrade, such as plagiarism or AI writing detection, is generated using algorithms and may not be completely accurate in all cases. Teachers should independently verify any critical findings.

Free Trial and Subscription

  1. Free Trial: VibeGrade offers a free trial, which includes grading for up to 25 essays per month. By signing up for the free trial, you agree to these Terms of Service.

  2. Paid Subscription: After the free trial, continued use of VibeGrade will require a paid subscription. Subscription details, including pricing and billing cycles, are available on our website. By subscribing, you also agree to the Terms of Service.

User-Generated Content

  1. Rubrics and Feedback: Teachers can create and upload rubrics to VibeGrade. Rubrics published on the rubric library page may be copied and used by other users even if they are later removed. VibeGrade reserves the right to store and make rubrics publicly available to others on the platform.

  2. Ownership: VibeGrade does not claim ownership over user-generated rubrics or other content. However, by publishing content on VibeGrade, you grant us permission to host and share your content with other users as described.

Payment Terms

  1. Currency: All purchases and subscriptions are processed in USD. Prices are subject to change, and any changes will be communicated to you prior to your next billing cycle.

  2. Refund Policy: Subscriptions are final sale. Refunds will not be provided once a purchase is made.

User Conduct

  1. Appropriate Use: You agree to use VibeGrade only for lawful purposes and in accordance with these Terms of Service. Any misuse of the platform, such as uploading inappropriate content or attempting to manipulate the AI's results, may result in suspension or termination of your account.

Account Termination

  1. Termination Rights: VibeGrade reserves the right to suspend or terminate your account at our sole discretion if you violate these Terms of Service or misuse the platform.

  2. Termination of Service: VibeGrade may terminate your access to the service at any time, with or without notice.

Limitation of Liability

  1. Disclaimer: VibeGrade is provided "as is" without warranties of any kind, either express or implied. We do not guarantee the accuracy of any data or results provided by the AI system. VibeGrade will not be liable for any damages, losses, or errors resulting from your use of the platform.

  2. Teacher's Responsibility: The final responsibility for assigning grades and verifying content lies with the teacher. VibeGrade serves as a tool to assist in grading, but it is not responsible for the final grading decisions made.

Privacy and Data Use

  1. Data Collection: By using VibeGrade, you agree to our collection and use of personal data as outlined in our Privacy Policy.

  2. Data Security: While we take reasonable steps to protect your data, we cannot guarantee the security of any information transmitted via the internet.

Governing Law

If you are accessing or using the Service from within Canada, these Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, without regard to its conflict of law provisions. If you are accessing or using the Service from within the United States or any other jurisdiction, these Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

Changes to the Terms of Service

VibeGrade reserves the right to update or modify these Terms of Service at any time. Significant changes will be communicated to users via email or the platform, and continued use of the service will constitute your acceptance of the modified terms.
